ABS-CBN to Appeal TRO vs Reporting on TV Ratings Manipulation

ABS-CBN Broadcasting Corporation said it will take legal action to reverse a temporary restraining order (TRO) granted by a Quezon City Regional Trial Court preventing the network from airing reports pointing to GMA Network as behind the manipulation of TV ratings published by

AGB Nielsen Media Research.

In an official statement, ABS-CBN said that the TRO "is a prior restraint that violates ABS-CBN's constitutionally-guaranteed freedoms of speech and of the press."

ABS-CBN said that the issue of corruption as brought out by the discovery of the TV ratings manipulation is a matter of clear public interest, and therefore needs to be reported on.

"Corruption is a matter of public interest regardless of where it is found. Thus, whether it be in the executive, legislative, or judicial branches of government, or even the private sector, it is the responsibility of media to expose corruption. All who are liable must be held accountable."

ABS-CBN also deplored the granting of virtual immunity to GMA Network, Inc. "[The TRO] grants GMA Network a virtual immunity from accusation. No person or entity has ever enjoyed such a privilege, not even the highest public officers of the land. It is a clear attempt to cover up and suppress information on the ratings manipulation issue."

QC-RTC Branch 95 presiding judge Henri Jean Paul Inting wrote in his decision that the ratings controversy between GMA Network and ABS-CBN has become a matter for the court to decide.

Inting said that reports by ABS-CBN imputing the ratings manipulation to GMA Network, Inc., will "cause great or irreparable injury to GMA Network’s reputation and good name as GMA Network, by publicity, will be adjudged by the public as guilty thereof."

The judge added that such reports, "may undermine the right of GMA Network to a fair trial and due process."

"I hope ABS-CBN would be quiet now and would respect the TRO issued by the court. If ABS-CBN says nothing against GMA Network, then GMA Network would have nothing to say in response because GMA only acts in defense," said GMA Network legal counsel Gene Asuncion.

GMA Network VP for Legal Dick Perez said that he is glad that the court saw the soundness of GMA Network’s application for TRO. "The issue is not about prior restraint or press freedom but about fairness. A media organization, which is a party litigant in a case, cannot invoke press freedom to present its case in public," Perez said.

The hearing on the application for the issuance of a Writ of Preliminary Injunction has been set on February 19.

The full official statement of ABS-CBN is as follows:

"ABS-CBN is extremely disappointed with the court order which restrains the airing of legitimate news reorts on a matter imbued with a clear public interest.

"Corruption is a matter of public interest regardless of where it is found. Thus, whether it be in the executive, legislative, or judicial branches of government, or even the private sector, it is the responsibility of media to expose corruption. All who are liable must be held accountable.

"The temporary restraining order prohibiting news reports that mention GMA Network, Inc. as the party behind the manipulation of television and radio ratings is a prior restraint that violates ABS-CBN's constitutionally-guaranteed freedoms of speech and of the press. It grants GMA Network a virtual immunity from accusation. No person or entity has ever enjoyed such a privilege, not even the highest public officers of the land. It is a clear attempt to cover up and suppress information on the ratings manipulation issue.

"ABS-CBN further maintains that continued news reporting on GMA Network's involvement in connection with the ratings manipulation will not deprive it of a fair trial inasmuch as the issue pending before the court is the accuracy of the ABS-CBN news report on AGB General Manager Maya Reforma's disclosure in her interview and affidavit submited in court, and not the culpability of GMA Network.

"ABS-CBN will take legal action to reverse and set aside the temporary restraining order."

Kris Aquino Talk About the TV Ratings Issue

Kris Aquino Talk About the Ratings Issue.

"But I think it's another Susan Roces vehicle, but not any of those na na-announce niya."

Sabi niya, ‘Kris naman, in your 30s, ikaw ang title-roler. This opportunity only comes once. Kailan ka babalik? When you are a lola?'

I was sick for 12 straight days because of that. That's really wrong for your health. So, dapat talaga inaayos nang matino yung schedule," lahad ni Kris.

RATINGS ISSUE.

So, text sila, ‘My God! Ang lakas talaga!'

"So, sabi ko, doon ako naniniwala. Sabi ko, ‘Oh, my God! Ratings na nila, malakas pa.' So, sabi ko, siguro malakas talaga. So, kahit na yung parang kahit buong katawan namin kinakagat ng lamok, kasi yung area na yun [location] super malamok, ha. Kasi parang semi-abandoned yung house. Mga ten years na 'ata na hindi nag-i-stay yung mga kids and all. So, may mga areas na parang hinihika-hika na ako and all.

No choice, higa ako.

"You know, we are no longer involved in each other's life so, it's off for me to comment," maikli niyang pahayag.

"Ayokong mag-comment. We never fought but we're just not close. So, yun. So, huwag na lang ako mag-comment talaga. Kasi anyway, basta yun na yun. Quiet Krissy," nakangiting sabi niya sa sarili.

HER SONS' CRUSHES.

"KC knows kasi si Juan Sarte fix me for this and normally does my ano... Sabi ko, 'At least, you have a good taste, honey!'" tawa ulit ni Kris.

NEW BUSINESS.

Basta sabi niya mangyayari 'yan. Mga five years siguro. Siyempre pag-iipunan mo. E, di siyempre, ang come on mo mango picking.

Court tells GMA-7, ABS-CBN to Submit Memo for Case Resolution

The Quezon City Regional Trial Court has ordered GMA GMA Network Inc. and ABS-CBN Broadcasting Corp. to submit their rejoinders so that it can decide on the GMA's petition to stop ABS-CBN from airing stories or plugs regarding the alleged ratings manipulation.

The court said the affidavits should be filed by Monday next week.

ABS-CBN was scheduled to present three more new witnesses during Tuesday’s hearing but Judge Henri Inting wanted to...

to submit the case for resolution, saying that he already heard enough evidence.

ABS-CBN lawyer Regis Puno said the company wanted to present more witnesses but the judge felt the evidence was already sufficient for him to make a ruling.

Lawyer Gener Asuncion of GMA, on the other hand, maintained that ABS-CBN should stop airing any plug and story pending the resolution of the case.

On Monday, an ABS-CBN informant told the court that the metered homes of research firm TNS-Trends in Bacolod City were also allegedly targeted for tampering by a local TV network.

Informant Johnny Aliguin told the court that he and his companions were instructed by Jonathan Cabillon, station manager of RGMA Iloilo, to look for metered homes of AGB Nielsen Media Research Philippines and TNS Philippines in Bacolod City.

GMA, however, dismissed Aliguin’s testimony as nothing but a tall tale.

Aliguin earlier said that he was hired by RGMA, which manages GMA Network’s provincial stations, to locate and bribe AGB panel homes in Bacolod City allegedly in an effort to tamper TV ratings in that area.

Aliguin said that his group was able to locate and bribe metered homes of both AGB Nielsen and TNS Trends in Bacolod. He said his group offered groceries and cash to convince panel home members to switch to a rival channel.

He said he was later instructed to abandon the alleged illegal operations and focus on AGB’s metered homes.

TNS has begun setting-up operations for television ratings but it has yet to release its data.
